Africa's Quest for Justice and Economic Independence Beyond ICC & Colonial Legacies
Sputnik Africa
From selective ICC justice to coercive US trade tactics, this episode sheds light on how Africa faces a new layer of colonialism and why sovereignty now depends on reforming global institutions and building continental self-reliance.
In this episode, Advocate Achero David Mufuayia, of the High Court of Kenya and proprietor of Achero Mufuayia & Co. Advocates dissected the most acute crisis of confidence in the International Criminal Court's history—the suspension of its own prosecutor, Karim Khan, for alleged sexual misconduct, while the same court issued rapid arrest warrants for African leaders. According to him, something new can emerge from this crisis: a demand for an authentic, multipolar, accountable justice where African voices are no longer just witnesses but architects.Meanwhile, Professor Fredrick Ogola, the author of Solomonic Economics, revealed how American meat exporters are now seeking to use the African Growth and Opportunity Act, also known as AGOA, as leverage—threatening trade preferences unless African nations open their domestic agricultural markets. He pointed out that the era of development charity is over, and Africa—with the world's fastest-growing population, with critical minerals that power the green transition, and with the AfCFTA as a potential shield—is no longer a supplicant.Curious to hear more? Africa's Quest for Justice and Economic Independence Beyond ICC & Colonial Legacies
According to him, something new can emerge from this crisis: a demand for an authentic, multipolar, accountable justice where African voices are no longer just witnesses but architects.
“Africa as a continent has institutions that have enforceability mechanisms and trial mechanisms. We also do have instruments that will help reinforce trials of Africans by Africans. Now, for instance, on the African continent or under the African Union Commission, we have the African Court of Justice and Human Rights, which is charged with ensuring that there is enforcement of the African Charter [...] Cases such as genocide, crimes against humanity, war crimes, and some unconstitutional changes of government can be handled at the African level, rather than making us believe that we can only take the cases to either the ICC or the ICJ for us to get justice,” the advocate stated.
Meanwhile, Professor Fredrick Ogola, the author of Solomonic Economics, revealed how American meat exporters are now seeking to use the African Growth and Opportunity Act, also known as AGOA, as leverage—threatening trade preferences unless African nations open their domestic agricultural markets. He pointed out that the era of development charity is over, and Africa—with the world's fastest-growing population, with critical minerals that power the green transition, and with the AfCFTA as a potential shield—is no longer a supplicant.
“AGOA is no longer just about governance and democracy. It is increasingly becoming a tool for securing markets, minerals, and economic advantage [...] the new colonialism is not arriving with military occupation. It is arriving through contracts, trade conditions, and market access standards. Africa must trade with the world without surrendering its sovereignty [...] The wisdom of Solomon teaches us that wealth is not measured by what leaves your country but by the value you create before it leaves. Africa's future lies not in exporting raw materials and importing finished products but in transforming its resources into jobs, industries, and prosperity at home,” the professor explained.
