Selective Justice is Killing the ICC’s Credibility, Kenyan Lawyer Says

“If the ICC and ICJ do not really establish mechanisms that show they are not shying off… then people will lose faith,” Kelvin Mugambi Kubai, lawyer for the African Center for Corrective and Prevention Action, told Sputnik Africa.

In his view, the double standards in how international law is applied—especially by powerful Western states—are undermining trust in global justice institutions.

Kubai pointed to the hypocrisy of nations that once championed human rights now refusing to enforce ICC warrants, including those targeting their allies like Netanyahu.

“There has been this wayward abuse and disregard of the jurisdiction of the ICC and ICJ,” he noted.

But with African states like South Africa and The Gambia taking bold steps at the ICJ, Kubai believes there’s a path forward—one where African countries assert a stronger voice and demand consistency in the enforcement of international law.
