THE HAGUE (Sputnik) - On December 29, 2023, South Africa filed an application with the United Nations' International Court of Justice, accusing Israel of genocide against the people in Gaza.
The International Court of Justice (
ICJ) has ordered Israel to take urgent measures to prevent acts of genocide and ensure the flow of humanitarian aid to the Gaza Strip, Court President Joan Donoghue said on Friday.
"Israel must, in accordance with its obligation under the genocide convention [Convention on the Prevention and Punishment of the Crime of Genocide] in relation to Palestinians in Gaza, take all measures within its power to prevent the commission of all acts [...] of killing members of a group, [...] causing serious bodily or mental harm to the members of the group, [...] Israel must ensure with immediate effect that its military forces do not commit any of the aforementioned acts," Donohue said, announcing temporary measures that Israel must take as part of South Africa's claim under the Genocide Convention.
Israel must ensure that humanitarian aid arrives in the Gaza Strip, the ICJ ruled.
"Israel must ensure the immediate and effective measures to enable the provision of urgently needed basic services and humanitarian assistance to address the adverse conditions of life faced by Palestinian in the Gaza Strip," Donoghue said.
ICJ Decision on Gaza Can Be Implemented Only Under Ceasefire
The decision of the ICJ on the Gaza Strip can be implemented only if a ceasefire is in place, South African Foreign Minister Grace Naledi Mandisa
Pandor said on Friday.
"I believe that in exercising the order, that would have to be a ceasefire. Without it, the order does not actually work," the minister told reporters.
South Africa filed a lawsuit accusing Israel of genocidal intent in Gaza with the ICJ on December 29 in response to a rising civilian death toll in the besieged Palestinian enclave.
